Analysis of Failure to Capture Market Share

Retained by Robbins Geller Rudman & Dowd LLP

Vega Economics supported two leading experts—Professor John M. Newman of University of Miami and Professor Arun Sundararajan of NYU—in preparing declarations submitted in support of Lead Plaintiffs’ motion for leave to amend their complaint in In re Adobe Inc. Sec. Litig.

The motion followed the Court’s initial dismissal and addressed the Court’s guidance. The expert declarations supported the allegations of tangible harm to Adobe as a result of its failure to capture customers and market share from Figma. These declarations further substantiated the importance of Adobe XD to the Creative Cloud bundle of applications and, by extension, the Digital Media business segment.

Professor John M. Newman is a lawyer with antitrust expertise and experience at the Federal Trade Commission, and Professor Arun Sundararajan is an expert in antitrust in technology industries.
